INFORMATION REQUIREMENT CLAUSE


Dear Sir/Madam,

Pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the GDPR), please find below information regarding the processing of your personal data.


PERSONAL DATA CONTROLLER

W2 Poland sp. z o.o. with its registered office at the address: ul. Ceramiczna 1A, Kruszyn Krajeński (postal code: 86-005), telephone: 52 522-32-38, e-mail address: biuro@w2.com.pl, is the controller of your personal data.


PURPOSE AND LEGAL BASIS FOR PERSONAL DATA PROCESSING

Your personal data will be processed for the following purposes:

  • to conclude and perform the agreement, including contact regarding performance of the agreement, and to take action, at your request, prior to concluding the agreement (legal basis: Article 6(1)(b) of the GDPR),
  • to obtain access to the Strefa Klienta website and its resurces – based on your consent (legal basis: Article 6(1)(a) of the GDPR),
  • to market and promote products and services offered by the Controller (legal basis: Article 6(1)(f) of the GDPR),
  • to respond to messages/inquiries, including through the contact form (legal basis: Article 6(1)(f) of the GDPR),
  • to present the offer – based on your consent (legal basis: Article 6(1)(a) of the GDPR),
  • to fulfil the legal obligation imposed on the Controller, namely to keep the Controller’s accounting books and to make the Controller’s tax settlements (legal basis: Article 6(1)(c) of the GDPR),
  • for internal administrative purposes, including in particular analyses, statistics, statements and reports (legal basis: Article 6(1)(f) of the GDPR),
  • to establish, exercise or defend legal claims (legal basis: Article 6(1)(f) of the GDPR).

With regard to the personal data of the counterparty’s contact persons and representatives, we process contact details and data related to the function/position held in the entity represented by these persons. Personal data (name, surname, telephone number, position, place of work) have been provided to the Controller by the entity represented by the person concerned.

Personal data of these persons are processed for the following purposes:

  • to establish and pursue cooperation with an entity represented by the person concerned (legal basis: Article 6(1)(f) of the GDPR),
  • to inform about the Controller’s offer (legal basis: Article 6(1)(f) of the GDPR),
  • to pursue or defend claims against an entity represented by the person concerned (legal basis: Article 6(1)(f) of the GDPR).

Providing data is necessary to conclude agreements and make business settlements. Providing other data is voluntary.


PERSONAL DATA RETENTION PERIOD

Your personal data will be retained for the period necessary for the implementation and settlement of cooperation and until the expiry of the periods prescribed by law, namely the expiry of the limitation period for tax liabilities related to accounting documentation and the limitation of claims under civil law.

For personal data processed based on your consent, such data will be processed until you withdraw your consent.

For personal data processed based on the Controller’s legitimate interest, such data will be processed until an objection is made.

The data provided through the contact form will be processed for a period of 3 years in order to preserve the principle of accountability.


RECIPIENTS OF PERSONAL DATA

Recipients of your personal data will include:

  • authorised Controller’s employees,
  • entities conducting postal or courier activities,
  • Controller’s business partners,
  • banks,
  • state authorities or other entities authorised under the law,
  • entities providing services (in particular IT and technical support services) to the Controller.

AUTOMATED DECISION-MAKING, PROFILING

Your data are not subject to automated decision-making, including profiling.


TRANSFER OF PERSONAL DATA TO A THIRD COUNTRY OR INTERNATIONAL ORGANISATIONS 

Your personal data will not be transferred to any third country or international organisation.


RIGHTS OF PERSONS WHOSE DATA ARE PROCESSED

You have the right to access, rectify or delete your data, or limit their processing, the right to transfer data and the right to file a complaint with the supervisory body, which is the President of the Office for Personal Data Protection.

If the legitimate interest of the Controller is the basis for the processing of personal data, you also have the right to object to the processing of personal data at any time.

For personal data processed on the basis of consent, you have the right to withdraw it without affecting the lawfulness of the processing carried out on the basis of your consent before its withdrawal.

You may exercise the above rights by:
